Woźniak Legal continues to act on behalf of the members of a homeowners association in a class action against Dom Development S.A., one of the biggest property developers in Poland.
The dispute involves construction defects in a luxury apartment building. This is the first class action in Poland against a property developer, and one of the few class actions which were admitted to a merits hearing before the court.
Class actions in Poland are regulated by the Law on Class Actions of 2009. The Law has been subject to wide-spread criticism. However, the jurisprudence regarding class actions is still in the process of formation. The above mentioned case against Dom Development S.A. will be a landmark decision.
